Our approach

Residential property

Expand

If a property within the trust or estate is occupied and you have instructions to take possession so that the property can be sold; we can provide a fully comprehensive service to transfer up enforcement to the High Court, issue a Writ of possession and recover the property. We will also provide a quotation for clearing the property and putting in place security measures to deter any unwanted damage or trespass.

We see our most challenging operations when the parties are related or connected through friendship. By placing your trust in The Enforcement Agency, you instruct professionals to enforce the decision of the court whilst prioritising personal safety. All occupants will be served with eviction notices at least 15 days before eviction and we allow time for the occupants to gather personal effects. Police are duty bound to assist enforcement agents executing writs so you can rest assured that we can call on support for the most challenging of enforcement actions.

Following eviction, we serve notices under the Torts (Interference with Goods) Act 1977 and provide you with a comprehensive report detailing the attendance. We can then return upon expiry to remove any abandoned goods and dispose of them accordingly.

Return of goods

Expand

In recent years, our management and agents have seen an increasing number of orders for the delivery of goods owned by an estate. The reasons for litigation can often be the subject of dispute and locating the goods is not always straightforward. The need for this type of enforcement arises when items are taken from a deceased person's estate or the items are with a third party for safekeeping. Some examples include legal documents, vehicles, jewellery and antiques.  Whatever the scenario, help is at hand to explain the options you have for recovering the goods.
